BlazeHosting Terms & Conditions

The following is the terms and conditions of agreement between BlazeHosting and you, the "Client", for email marketing services. These terms and conditions are all agreed upon by you, the "client", by purchasing our email campaign service.
Right to Refusal
BlazeHosting reserves the right to refuse any or all services based on our company policy of respectable marketing practices at anytime. BlazeHosting holds strict rules and regulations for our email marketing services and our affiliated servers. BlazeHosting will not host or email broadcast for illegal sexual content, illegal pirated software, hate or discriminating messages, or website of any type.
Email Marketing Campaign
The client acknowledges and agrees upon that there are no guarantees of successes on email marketing campaigns. Like any form of traditional advertisement, email marketing has its success and failures due to marketing conditions or other factors. BlazeHosting cannot be held liable or responsible for an unsuccessful email marketing campaign outside of our immediate control.
Payment
The client acknowledges and agrees upon that all financial information given to BlazeHosting via credit card or any other payment method is lawfully theirs and true. The client acknowledges that all payments are due in advance and that BlazeHosting maintains a no-refund policy after an email marketing campaign is executed.
Payment Method and Processing Fee
All orders are subject to a $25.00 processing fee and returned checks are subject to a $50 returned check fee.
Charge Backs
While we do not guarantee the results of our service/products, we try hard to address anyone that is unsatisfied. Due to the perishable nature of our products/services, all sales are bound to these stated terms and conditions. Purchaser will at no time dispute or chargeback any charges for products/services performed as stated in their invoice.
Pricing
Prices listed on the website or in any publication produced by BlazeHosting are subject to change. Purchaser agrees to pay the invoice amount according to the card issuer agreement. The amount is due upon receipt and a finance charge of 10% per thirty days shall be added to the balance due to the extent that the balance is not paid within thirty days from the invoice date.
Altering Orders
Any alterations to orders must be in printed type. Hand written changes must be reincorporated into a new signed invoice.
Credits and Refunds
BlazeHosting does not issue refunds on completed orders but instead will issue replacement campaigns and/or credits at the discretion of the BlazeHosting Management.
Cancellations
No cancellations can occur on one-time email campaigns. Cancellations during multiple campaigns will be handled on a case by case basis at the discretion of the BlazeHosting Management. Cancellations require 48 hour notice. Refunds are subject to a fee assessed by BlazeHosting management associated with the cost of the forfeited email campaign(s).
Fraud
In the case of a fraudulent transaction made by the client, who may or may not be the legal owner of any type of funds used for the purchase of any service/product offered by BlazeHosting including: credit card, debit card, wire transfer, check, money order, or Western Union, etc., this client or purchaser may not hold BlazeHosting liable or responsible in any manner, regardless of whether the client or purchaser knew in whole or part that his/her actions were fraudulent. In the case that a fraudulent transaction is made, we will make every effort in returning the money to the legal owner or victim of the funds, which may include: credit card, debit card, wire transfer, check, money order, or Western Union, etc. and we shall prosecute the person or persons who committed the fraud to the fullest extent of the law using all legal means necessary.
Email Sources
The source of our emails may change at any time. For example, your campaign may be delivered using a different publisher. This will not affect pricing in most cases but we reserve the right to notify you if we cannot run your campaign due to a list or category price change, or the email list becoming unavailable. In such cases, we will issue a refund or the difference whichever is most appropriate per case at the discretion of the BlazeHosting Management.
Abandoned Email Campaigns
Email campaigns that remain in queue or are suspended for over 30 days will be considered abandoned and may be subject to termination. Such campaigns are non-refundable.
Indemnification
The client agrees and acknowledges to hold BlazeHosting and all its employees harmless from any liability, loss, claims, and expenses related to any or all email marketing campaigns.
Warranties
All parties acknowledge that the email campaigns are provided on an “as is” basis and no other representations and warranties, express or implied, including their fitness for a particular purpose, their merchantability, and/or non-infringement apply to the email campaigns or this transaction.
BlazeHosting reserves the right to change the terms and conditions at anytime and without notice. We ask that you read our terms and conditions before each order is submitted.
